Licensed Application End User License Agreement

Applications made available through OGApps are licensed, not sold, to you. Your license to each application is subject to your prior acceptance of this End User License Agreement ("EULA"). Your license is granted by OGApps, and OGApps reserves all rights in and to the application not expressly granted to you.

1. Scope of License

OGApps grants you a nontransferable license to use the applications on any devices you own or control. Except as permitted by this agreement, you may not distribute, make available, or sublicense the applications. Specifically, you may not:

• Copy, modify, or create derivative works of the applications
• Reverse-engineer, disassemble, attempt to derive the source code of, or otherwise attempt to discover the secrets of the applications
• Sell, transfer, sublicense, or otherwise transfer rights to the applications
• Use the applications for any purpose that violates applicable law

2. Consent to Use of Data

You agree that OGApps may collect and use technical data and related information about your use of the applications, including but not limited to technical information about your device, system and application software, and peripherals. OGApps may use this information to improve its applications or provide services to you. This information will not personally identify you.

3. No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APPLICATIONS IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND OGAPPS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APPLICATIONS, EITHER EXPRESS, IMPLIED, OR STATUTORY.

OGAPPS MAKES NO WARRANTIES OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

4. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL OGAPPS BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATIONS.

IN NO EVENT SHALL OGAPPS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00). THESE LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

5. External Services

The applications may enable access to third-party services and websites ("External Services"). You agree to use External Services at your sole risk. OGApps is not responsible for examining or evaluating the content or accuracy of External Services and shall not be liable for any such third-party services. OGApps reserves the right to change, suspend, remove, disable, or impose restrictions on any External Services at any time without notice.

6. Prohibited Use

You agree not to use the applications for any unlawful purposes or in any way that could damage, disable, or impair the applications. Specifically, you may not:

• Harass, threaten, abuse, stalk, or defame any person
• Transmit viruses, worms, defects, or any code of destructive nature
• Attempt to gain unauthorized access to the applications or related systems
• Export or re-export the applications in violation of applicable export control laws
• Use the applications to develop nuclear, missile, chemical or biological weapons

7. Termination

This agreement is effective until terminated. Your rights under this agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the applications and destroy all copies in your possession.

8. Governing Law

This agreement is governed by the laws of the jurisdiction where OGApps is located, excluding its conflicts of law provisions. You agree to submit to the exclusive jurisdiction of the courts in that location for any dispute arising from this agreement.

9. Government Use

The applications are "Commercial Items" consisting of "Commercial Computer Software." If licensed to a government entity, the applications are licensed with rights restricted as permitted by applicable government procurement laws.
